Effective on April 1, 2021 The Department of Homeland Security (DHS) issued temporary flexibility in the completion of Form I-9. Specifically, if employees were hired on or after April 1, 2021 and worked in an exclusive remote position due to COVID-19 precautions, were temporarily exempt from physical inspection of Form I-9 documents.
This temporary exemption existed until the employee undertakes consistent non-remote employment. Once normal operations/employment resumes, all remote employees reported to employer for document inspection within 3 business days.
The flexibility only applied exclusively to remote-work employees. If there were employees physically present at the employment location, no exceptions or flexibilities were allowed.
In October 2022, DHS announced an extension of the Form I-9 flexibilities until July 31, 2023. Click here for the full DHS announcement.
With the flexibilities ended, employers must revert to original Form I-9 Compliance standards.
Employers are responsible for monitoring the DHS and ICE website for updates regarding Form I-9 flexibilities.
